On October 30, 2020, the U.S. Department of Health and Human Services (HHS) announced the publication of its final 2020-2025 Federal Health IT Strategic Plan. Developed by the HHS ONC in collaboration with 25 federal organizations and formed with input from 100 public comments, this plan outlines federal goals and objectives for Health Information Technology (Health IT) and focuses specifically on the access of individuals to their electronic health information.

According to a report from Grandview research, the market for patient engagement solutions is expected to grow by 4x between now and 2026, reaching $56.92 billion USD. Patient engagement has become increasingly important in recent years, driven by a number of factors. First and foremost, you have two young and tech-savvy generations (millennials and Gen Z) coming into adulthood and expecting more personalized online options from their care providers. At the other end of the generational spectrum, there is the last of a large aging population of baby boomers entering their later years, many of whom desire to “age in place” without losing the personal touch they’ve come to expect from their care providers. In response to the surging demand these factors have caused, the healthcare industry is experiencing a boom in patient engagement solutions.

Halloween is upon us once again, little gremlins. This year’s Halloween was supposed to be legendary. In case you weren’t aware, October is National Cybersecurity Awareness Month. For those in the healthcare industry, unfortunately, cybersecurity awareness is something many are still lacking. According to a report from Hervajec Group, the healthcare industry is expected to spend $65 billion on cybersecurity from 2017 to 2021. All that money being spent, and yet healthcare remains one of the most frequently targeted and worst performing sectors when it comes to cyberattacks and data breaches. Why is that? Well, it is likely because while so much of that money is being spent on technology (antivirus software, firewalls, etc.), not enough time and money is being invested in the training of people.

In addition to the Information Blocking updates we discussed in a recent blog post, the 21st Century Cures Act Final Rule also requires use of Cures Act Edition certified software. This will include some new and revised certification criteria. Providers will need to have their EHR updated with these new requirements in time for the 2022 reporting period. The information blocking requirements of the Cures Act Final Rule will take effect on November 2, 2020. This means healthcare providers have barely a month to ensure they are in compliance or risk financial penalties. When it comes to allowing proper access to information as required by HIPAA, commonly called “Right of Access,” regulatory entities have already begun cracking down on violators. In 2019, the Office for Civil rights (OCR) at HHS had announced its intention to more aggressively enforce the rights of patients to have prompt access to medical records without being overcharged for it.

No matter whether your practice is small or large, creating a Quality Improvement Team can provide the ability to remain viable in today’s rapidly changing healthcare landscape. Practices now face penalties up to 9 percent for 2020 and 2021 (an increase of 5 percent from when MIPS started) for poorly demonstrated performance. These penalties will only increase as the years go on, reaching 11 percent by the end of 2023. However, for practices that are able to properly demonstrate high quality and value, bonus potential continues to rise as well. In addition to MIPS, many insurance companies offer incentive programs with significant bonuses based on demonstration of high quality and value in a practice.
